Navigating Real Estate Laws in Dubai: A Guide for Lawyers

Editorial correction — 2 October 2026. The former 2023 overview described longstanding statutes as “new” developments and asserted a general 49% foreign-investor share cap outside designated ownership areas without identifying a supporting provision. This replacement states the narrower Dubai Land Department framework and removes that unsupported generalisation.

System and scope: Dubai onshore real-property acquisition and registration. This note does not address DIFC property, Abu Dhabi or another Emirate, financing, tax, succession, landlord-and-tenant disputes or project-specific regulatory approvals.

Law checked: 2 October 2026. Next review: 2 April 2027.

Short answer

For a Dubai acquisition, confirm the buyer’s permitted title under Law No. 7 of 2006, verify the property and seller through Dubai Land Department records, identify whether the asset is completed, off-plan or jointly owned, and complete the transfer through the current DLD service channel. Do not describe every non-freehold interest as a 30–99 year “leasehold” or assume that a company structure avoids the designated-area rules.

1. Classify the asset and the buyer

Identify the plot or unit, development, completion status and intended buyer. Article 4 of Dubai Law No. 7 of 2006 governs who may own real property. Non-UAE nationals may obtain freehold ownership without a time restriction, or usufruct or long-term lease rights for up to 99 years, in areas designated by the Ruler and on the applicable conditions. Obtain the current DLD confirmation for the particular property and buyer; marketing language such as “freehold area” is not a substitute for the register.

2. Verify title and authority

Obtain the current title deed or off-plan registration record, seller identification, corporate authority where applicable and any power of attorney. Check the property status, restrictions, mortgage, attachment and developer requirements through the appropriate DLD channel. If the seller is a company, verify its licence, constitutional authority, beneficial owner information and signatory authority rather than relying only on a broker’s confirmation.

3. Distinguish completed and off-plan property

Law No. 13 of 2008 regulates the Interim Real Property Register for off-plan dispositions. Law No. 8 of 2007 governs real-estate-development escrow accounts. For an off-plan purchase, confirm the developer and project registration, the unit’s interim registration, the approved escrow account, the payment schedule and the consequences of delay or project cancellation. Avoid calling these 2023 measures; the statutory framework predates that year and has amendments and implementing decisions that must be checked.

4. Review jointly owned property documents

Dubai Law No. 6 of 2019 governs jointly owned real property. For an apartment or community asset, review the master-community declaration, building management statement, owners’ obligations, service charges, outstanding balances, permitted use and management arrangements. Confirm any developer or management-company no-objection requirement for transfer.

5. Document the transaction

Reconcile the memorandum of understanding or sale agreement with the official title and DLD data. State the price, deposit treatment, completion conditions, apportionments, mortgage discharge or financing steps, possession, risk, default consequences and responsibility for DLD, trustee, developer and broker charges. Do not quote a percentage fee from an old article; check the live DLD service card for the transaction type.

6. Complete DLD registration

The DLD property-sale registration service requires the parties or their authorised representatives to complete the prescribed registration process. Current requirements may include identity documents, corporate documents, a developer e-NOC in freehold areas and transaction-specific approvals. Registration—not the private contract alone—is the critical step for the transfer of the registered real right.

Transaction checklist

  • Exact property identifier, location and completion status.
  • Buyer eligibility and intended title under Law No. 7 of 2006.
  • Current title deed or Interim Real Property Register record.
  • Seller identity, corporate authority and power of attorney.
  • Mortgage, attachment, restriction and property-status checks.
  • Developer/project/escrow verification for off-plan property.
  • Jointly owned property documents and service-charge clearance.
  • Developer e-NOC and current DLD service requirements.
  • Sale agreement, payment trail and completion statement.
  • Final DLD registration evidence and issued title document.

Common errors

  • Generalising Dubai’s designated-area rules to the whole UAE.
  • Calling longstanding off-plan or jointly owned property laws “new.”
  • Assuming a foreign-owned company can acquire any Dubai land.
  • Treating a broker’s brochure or private contract as proof of registered title.
  • Quoting stale fees without checking the current DLD service card.
