AI Safety Whistleblower Takes xAI to Court, Claims Concerns Over Grok Led to His Dismissal

A legal battle is unfolding around Elon Musk’s artificial intelligence venture xAI after a former engineer alleged he was pushed out of the company for sounding alarms about AI safety and the potential dangers associated with its flagship chatbot, Grok.

The lawsuit, filed in a California state court, comes from Devin Kim, an early member of xAI’s engineering team who now leads a nonprofit organization dedicated to AI risk research. Kim contends that his repeated attempts to strengthen safety measures within the company placed him at odds with senior leadership and ultimately cost him his job.

According to court filings, Kim argued internally that inadequate safeguards around advanced AI systems could expose the company to serious legal and ethical risks. He claimed that insufficient oversight of Grok’s development could contribute to harmful outcomes ranging from discriminatory behavior to the misuse of powerful technologies.

The complaint paints a picture of mounting friction inside xAI. Kim alleges that while Musk expected rigorous safety evaluations and responsible development practices, those priorities were not consistently embraced by all members of the leadership team. In particular, the lawsuit accuses xAI co-founder Jimmy Ba of resisting proposed safety initiatives and dismissing concerns raised by Kim.

The dispute allegedly reached its breaking point in September 2025. Kim says he was terminated unexpectedly just before he was scheduled to present recommendations on AI safety to company executives.

The lawsuit accuses xAI and its parent company, SpaceX, of unlawful retaliation and wrongful termination under California law. Kim is seeking monetary damages, though the filing does not specify an amount.

The case arrives at a significant moment for SpaceX, which is preparing for a closely watched public offering expected to rank among the largest in history.

Kim joined xAI during its formative stages in 2024 and, according to the complaint, quickly rose into a senior leadership role. His legal challenge adds another chapter to the ongoing debate over how rapidly AI companies should advance their technology and how much emphasis should be placed on safety controls before releasing powerful systems to the public.

Musk launched xAI in 2023, presenting it as a company committed to developing artificial intelligence with a strong focus on humanity’s long-term interests. The new lawsuit, however, raises questions about how those ambitions translated into day-to-day operations inside the organization.

The allegations also revive broader scrutiny surrounding workplace and safety practices across Musk’s business empire. Over the years, several of his companies have faced criticism and legal challenges related to employee safety, product risks, and corporate culture. SpaceX has consistently defended its record, stating that it provides extensive safety training and maintains robust safety procedures.

Neither xAI nor SpaceX had publicly responded to the allegations at the time the lawsuit was filed.
