Practitioners should therefore check the current roster, notifications and any case-type-specific Registry direction before treating electronic filing as mandatory.
Short answer
Prepare a searchable A4 PDF, apply an accepted signature method, add readable annexures and correct court-fee details, and complete submission before 4:00 p.m. IST if the same working-day date matters. Twenty-four-hour portal access does not confer the same-day filing date after the cut-off. System failure does not extend limitation; use conventional filing where necessary.
When this procedure applies
The Electronic Filing Rules, 2021 cover fresh, pending and disposed matters in the High Court, subordinate courts and supervised tribunals. This note is confined to the High Court. Rule 5 limits portal registration to advocates practising before the covered courts or tribunals and registered with the Case Information System, and to self-represented litigants. A litigant in person must give an affidavit or undertaking that no advocate has been engaged.
Electronic filing has the same legal effect as conventional filing, but it does not displace the High Court Rules, Writ Proceedings Rules, a special statute or an order in the particular case.
Step-by-step filing workflow
- Confirm the proceeding and filing route. Check the High Court’s current notifications and the relevant case-type rules. Use the current High Court homepage link to the e-Filing Services portal.
- Confirm the e-filer account. Keep the registered email and mobile number current; filing and Registry notices are sent there. Do not share credentials because activity through the account is attributed to the e-filer.
- Prepare the native pleading. Rule 6 requires A4 pages, a legible font of at least 12 points, body text spaced at 1.5 or more, and pages numbered at the top in the centre or on the right. Minimum margins are 1.5 inches at the top and bottom, 1.75 inches on the left and 1 inch on the right. Text must be justified. Footnotes, tables, charts and indented blocks may use spacing of at least 1.15.
- Create a searchable PDF. Convert text documents to PDF/A or PDF; PDF/A is preferred. Annexures that exist only on paper should be scanned at a minimum resolution of 300 dpi, in A4 size, and checked page by page for completeness and readability. If an original is unclear, file the original image and an advocate-certified true typed copy. Local-language material may be accompanied by an advocate-certified English translation.
- Control file size and names. The maximum permissible upload size stated in rule 6 is 25 MB. Larger material may use a Common Service Centre or conventional filing where permitted. File names must not exceed 45 characters, including spaces. Avoid the prohibited characters listed in rule 7, including quotation marks, percent signs, ampersands, asterisks, colons, angle brackets, question marks, slashes, braces and pipes.
- Apply the correct signature method. An electronically filed document must bear the advocate’s or unrepresented litigant’s digital signature. The signature block must state the filer’s name, address, phone and email; precede the advocate’s typed name with “/sd/”. Where the filer lacks a digital signature certificate, the Rules allow Aadhaar authentication through the OTP sent to the mobile number registered with UIDAI. Affidavits and exhibits bearing original handwritten signatures must be scanned. A document required to be notarised, acknowledged, verified or made under oath must retain the handwritten signature; rule 6 also requires the original to accompany the pleadings by conventional filing.
- Deal correctly with leave and advance service. If leave is required to place a document on record, upload the proposed document with the application seeking leave. If granted, refile it for inclusion in the record. Where the Registry requires an advance copy, serve it physically or electronically and attach proof.
- Enter court-fee information. Rule 8 permits electronic court fee purchased through the Stock Holding Corporation of India or another authorised vendor for Jammu and Kashmir or Ladakh. Enter the generated payment code in the portal’s prescribed field. This note does not quote a fee because the amount depends on the proceeding and relief; verify the applicable schedule and any current Registry direction before payment.
- Submit before the effective cut-off. The portal may be available twenty-four hours, but rule 17 uses IST and treats online filing after 4:00 p.m. as filed on the following day, if that is a working day. A filing on a gazetted holiday or court closure is treated as filed on the next working day. Common Service Centre filing is permitted only up to 4:00 p.m. on a court working day. File early enough to complete upload, payment and final submission.
- Preserve proof and cure objections. Save the portal acknowledgement and the email and SMS proof of filing. Submission is not final scrutiny or listing. The Registry may notify errors and set a time for correction. The case proceeds for listing after objections are cleared. Monitor the dashboard, registered email and phone until the filing is accepted and numbered.

If the portal fails
Rules 17 and 18 are deliberately strict. Online downtime does not extend limitation. If an electronic filing cannot be completed, use a Common Service Centre on a working day or revert to conventional filing. The receiving officer may require a CD-ROM or other storage medium containing the PDF or PDF/A document. The Court may grant an exemption from electronic filing on application where e-filing is infeasible, privacy or confidentiality is at risk, the document cannot sensibly be scanned because of its size, shape or condition, the system is inaccessible, or another just and sufficient cause exists.
Originals and hard copies
Preserve scanned originals for production. Potentially disputed originals must ordinarily be kept for at least two years after final disposal, including appeals. Rule 9 requires permanent preservation of specified originals, including powers of attorney, wills and immovable-property sale or conveyance contracts. If the Court directs a hard copy, certify that it matches the soft copy; if they differ, the earlier-filed copy prevails.
Common filing errors
- Assuming a 10:00 p.m. upload receives the same working-day filing date.
- Waiting for a limitation-day portal failure instead of preparing a physical fallback.
- Uploading image-only pleadings, unreadable annexures or files above 25 MB.
- Using a filename longer than 45 characters or containing a prohibited symbol.
- Leaving an affidavit unsigned, omitting the contact details in the signature block, or failing to preserve the original.
- Paying a court-fee amount without checking the relief, statute and current schedule.
- Treating the submission acknowledgement as proof that Registry objections are cleared.
