EU Opens Broad Energy Compliance Cases Against Member States

The Commission has escalated cases involving energy security, efficiency, renewables and building renovation.

The European Commission has opened or escalated a wide group of infringement cases over energy law, giving member states two months in most matters to answer before further court action is considered.

Spain and France received formal notices for failing to notify updated electricity risk-preparedness plans, while Belgium received an additional notice. The plans are meant to prepare national systems for crises caused by extreme weather, cyberattacks or fuel shortages and to coordinate cross-border responses.

Greece, Spain, Italy and Malta were sent reasoned opinions over incomplete transposition of the recast Energy Efficiency Directive. Croatia received the same step over revised renewable-energy rules. Poland and Romania were pressed to correct gaps in their rules for offshore oil and gas safety.

Another nine states — Belgium, Czechia, Ireland, Italy, Luxembourg, Hungary, Malta, Poland and Slovakia — were issued reasoned opinions for continued failure to submit draft national building-renovation plans. Austria and Romania were also told to complete information missing from their national energy and climate progress reports.

These decisions are procedural, not judgments. Formal notices begin or expand an investigation; reasoned opinions are the final administrative warning before the Commission may refer a state to the Court of Justice. Each government may still provide new measures or explanations within the response period.
