CFTC Proposes Federal Route for Leveraged Crypto Trading

The CFTC has proposed a federal regulatory route for retail cryptocurrency platforms offering leveraged or margined trading.

The Commodity Futures Trading Commission has proposed a federal framework for cryptocurrency platforms that offer leveraged or margined trading to retail customers, a step toward moving a contested part of the market into a defined regulatory channel.

The proposal centres on two possible structures. One would create a new category for venues dealing in retail crypto transactions with leverage or margin. The other would adapt the existing system for designated contract markets and futures commission merchants. Both approaches would place trading under federal supervision rather than leaving platforms to test the edge of rules written for older products.

The agency is considering requirements aimed at market manipulation, custody and proof of reserves, as well as the role of regulated intermediaries between venues and customers. The details matter because a platform that resembles a spot exchange may fall within CFTC jurisdiction once a customer trades with borrowed exposure or the transaction is not completed through actual delivery.

This is an advance notice of proposed rulemaking, not a final rule. It asks market participants, consumer groups and other regulators to address the design choices before the commission decides whether to issue binding text. Existing law and enforcement authority remain in place during that process.

The initiative also reflects a broader institutional question. Congress has repeatedly debated a new division of responsibility for digital assets, but the agency is now examining what can be built under its present statutes. Any final regime will have to fit those limits and survive scrutiny over costs, investor protection and the treatment of decentralised systems.
