Roberts Pauses FCC Deadline in Political Ad Rate Dispute

Chief Justice John Roberts has temporarily suspended a deadline requiring the FCC to act on a political-advertising complaint.

Chief Justice John Roberts has temporarily suspended a lower-court deadline that required the Federal Communications Commission to decide a dispute over discounted political advertising rates.

The administrative stay preserves the status quo while the Supreme Court considers the government’s emergency application in case 26A476. It is not a final ruling on the merits. Roberts directed the challengers to respond by Saturday afternoon, giving the Court time to assess whether the lower court’s directive should remain blocked during further review.

The dispute concerns the “lowest unit charge” that broadcasters must offer candidates during election periods. Democratic candidates asked the FCC to revisit a March policy that extended the benefit to party committees buying coordinated advertising. After the agency did not act, the Fourth Circuit ordered it to issue a decision on a compressed schedule.

The government argues that the appellate court intruded on the agency’s control over its own proceedings. The challengers contend that continued delay has immediate electoral consequences. For now, the stay relieves the FCC of the court-imposed deadline without resolving either the agency question or the underlying advertising-rate policy.
