CFTC Proposes Treating Event Contracts as Swaps

The derivatives regulator wants event contracts on politics, sports, culture and weather expressly included in the federal swap definition.

The Commodity Futures Trading Commission has proposed expressly bringing a broad class of event contracts within the federal definition of a swap, a step that would clarify the agency’s claim to exclusive authority over a fast-growing market.

The proposal covers contracts tied to sports, elections and other political events, cultural outcomes and weather. These products let participants take positions on whether an event will occur, and their spread from specialist exchanges into mainstream trading has forced courts and regulators to confront where derivatives end and state-regulated gambling begins.

The commission said the contracts are commodity derivatives commonly understood in the trade as swaps. Writing that conclusion into the rules would do more than settle terminology: it would strengthen the legal basis for federal oversight and reduce room for states to characterize the same products as wagers subject to local licensing law.

The measure is not yet final. Market operators, state regulators, consumer groups and other interested parties will have 30 days after the proposal appears in the Federal Register to submit written comments. The agency could revise the text after reviewing those submissions.

The proposal also sits beside a separate interim rule excluding casino games and sportsbook wagers from the swap definition. Taken together, the two actions try to draw a legal boundary between event-based derivatives and conventional gambling rather than treating every contract linked to an uncertain outcome alike.

The CFTC’s notice describes the proposed scope and comment period.
