US Opens Constitutional-Rights Investigation Into D.C. Jails

The inquiry concerns force, medical care, sanitation and nutrition; the Justice Department says it has reached no conclusions.

Conditions in Washington, D.C.’s correctional facilities are under a new federal civil-rights investigation, with the Justice Department examining whether prisoners and detainees face a pattern of unconstitutional treatment.

The department notified Mayor Muriel Bowser on October 19. It identified allegations involving excessive force, inadequate medical care, unsafe or unsanitary conditions and insufficient nutrition.

Those matters remain allegations. The department expressly said it had reached no conclusions.

The inquiry proceeds under the Civil Rights of Institutionalized Persons Act, which gives the federal government authority to investigate patterns or practices that deny people in custody their constitutional rights. It is not a criminal charge against individual jail staff or a court finding that the District has violated the Constitution.

DOJ said information prompting the inquiry included a report from the District’s own auditor, alongside other complaints about detention conditions.

The next task is investigative: determining what the evidence establishes about the facilities and whether any systemic violation calls for remedial action. The announcement does not itself impose a new operating regime on the jails.
