FDA Finalises Drug-Labeling Framework for Sponsor Software

Final FDA guidance treats certain outputs from drug-linked software as prescription-drug labeling and explains sponsor submission duties.

The US Food and Drug Administration has issued final guidance explaining when software supplied by or for a drug company becomes part of the legal labeling framework for a prescription medicine.

The guidance addresses prescription-drug use-related software: tools disseminated by or on behalf of a sponsor that produce material supplementing, explaining or otherwise relating to one or more of the sponsor’s prescription products. It applies whether or not the software is also regulated as a medical device.

FDA’s central position is that material presented to a patient, caregiver or health professional through such software can be prescription-drug labeling. That classification brings the output within the agency’s drug-labeling authorities and can require the sponsor to submit the material for review.

The document also explains how prescribing information should address software that is essential to the safe and effective use of a drug. A separate pathway applies when a sponsor presents evidence that a software function provides clinically meaningful benefit. The agency says coordinated review is intended to avoid inconsistency where the same function also falls within the device-software regime.

Software developed and distributed independently, without dissemination by or on behalf of the drug sponsor, falls outside the stated scope. The dividing line therefore turns substantially on the sponsor’s role and the connection between the output and its products, not simply on whether the user accesses the tool through a phone or another digital platform.

The final guidance replaces the draft issued in September 2023 after consideration of public comments. It describes the agency’s current enforcement and submission approach; it is guidance rather than a regulation carrying the independent force of statute.
