NRC Streamlines Rulemaking and Security Procedures

A Nuclear Regulatory Commission rule updating information-withholding, advisory-committee and national-security procedures took effect on October 26.

The US Nuclear Regulatory Commission’s revised administrative procedures took effect on October 26, changing rules on withheld information, post-rulemaking comments, federal advisory committees and national-security eligibility.

The direct final rule amends Parts 2, 7 and 10 of the commission’s regulations. It removes procedural provisions the NRC regarded as outdated, aligns its advisory-committee rules with government-wide standards and updates the criteria used for access to classified information and sensitive positions.

Among the changes, the commission streamlines how certain requests to withhold information from public disclosure are handled and revises provisions governing comments submitted after a rule has been promulgated. It also updates references and terminology used in security determinations.

The NRC adopted the measure through a direct-final-rule process, a route used where the agency expects no significant adverse comment. The August notice said the rule would take effect on October 26 unless such comments required withdrawal. The Federal Register continues to list the rule as effective, and no withdrawal notice was identified before commencement.

The commission classified the measure as deregulatory and non-significant for federal regulatory-review purposes. It said the amendments do not impose new substantive burdens, change reactor backfitting requirements or affect the finality of existing approvals.

The rule responds to a 2025 executive order directing a broader review and modernisation of the NRC’s regulations. Its immediate effect is procedural: it changes how the agency conducts parts of its own regulatory work rather than altering a reactor licence or deciding an enforcement case.
