The Australian Securities and Investments Commission has proposed extending for five years an instrument that permits limited tax advice connected with financial products outside the ordinary financial-services licensing scope.
The instrument, due to sunset on 1 April 2027, applies to Australian financial services licensees and their authorised representatives. It allows specified tax advice to be given with a modified disclaimer, rather than treating the advice as a separate licensed financial service.
ASIC’s consultation proposes a remake with minor updates and no substantive change to the exemption’s effect. The regulator is seeking submissions by 25 November 2026 before deciding whether to preserve the arrangement.
The paper is a consultation, not a final legislative instrument. The present exemption remains in force while ASIC considers the response and the approaching sunset date.
