ABC Seeks Order Halting FCC License Review

A federal judge heard competing arguments over free speech, jurisdiction and an early review of eight ABC station licenses.

ABC asked a federal judge to halt the Federal Communications Commission’s early review of eight station licenses, arguing that the process is retaliatory and is already constraining editorial decisions.

At a two-hour hearing, ABC and parent company Disney sought a preliminary injunction that would stop the commission from advancing the renewal proceedings or using them to pressure the network’s programming. The licenses remain valid. The immediate question is whether the court should intervene before the FCC issues a final order.

That timing shaped the government’s response. Justice Department lawyers argued that the District Court for the District of Columbia lacks jurisdiction because Congress created a separate route for reviewing commission action. They also said ABC had not shown irreparable injury: the stations remain on air, and the commission has not denied or revoked a license.

ABC answered that the injury is the present chill on speech, not merely the possibility of losing a license later. Its complaint says the FCC demanded renewal applications years ahead of the normal schedule for stations in New York, Chicago, Philadelphia, North Carolina, Texas and California. The network alleges that the unusual step followed public criticism of its content by President Donald Trump and FCC Chairman Brendan Carr.

The court has made no finding that retaliation occurred. Judge Loren AliKhan pressed both sides on jurisdiction, the First Amendment claim and the showing required for emergency relief. She did not rule from the bench and ordered further written submissions from the government by October 9 and ABC by October 14.

The result will turn on more than the merits of ABC’s speech claim. If the judge concludes that the statutory review scheme places the dispute elsewhere, the case may end in district court without resolving whether the early license process was unconstitutional. If jurisdiction exists, the court must then decide whether the threat and alleged editorial restraint are sufficiently immediate to justify an injunction before final agency action.
