Arizona’s attorney general has sued Botanic Tonics, accusing the company of presenting its kratom-and-kava “Feel Free” drinks as benign wellness products while obscuring the possibility of addiction and withdrawal.
The complaint, filed on Wednesday, says the drinks were sold in Arizona as energy tonics and alternatives to alcohol. It alleges that the branding played down the presence of kratom, a psychoactive plant whose effects can resemble those of opioids, and that some marketing reached younger consumers.
Those assertions remain allegations. Botanic Tonics had not publicly answered the complaint when it was filed. The case begins a civil enforcement process in which the state will have to prove both the challenged representations and the legal consequences it says should follow from them.
The dispute arrives while state and federal authorities are taking a harder look at concentrated kratom products. Kratom itself remains lawful under federal law, but regulators have expressed concern about potency, labeling and products designed to deliver unusually high doses. Arizona says 146 deaths in the state between 2020 and 2023 were associated with kratom, a figure that does not by itself establish that kratom was the sole cause in each case.
The complaint is part consumer-protection action and part test of how an old set of advertising rules applies to a fast-growing category that sits awkwardly between supplements, recreational products and conventional drinks. If the state prevails, the consequences could extend beyond a single brand: clearer ingredient notices, more restrained health claims and warnings that match the way customers actually use the product.
