Delhi High Court Pauses Energy-Drink Label Ban

The Delhi High Court has temporarily stopped India’s food regulator from enforcing its energy-drink label ban against three major producers.

The Delhi High Court has temporarily stopped India’s food-safety regulator from enforcing a ban on the description “energy drink” against PepsiCo, Monster Beverage and Reliance Industries while their challenges are heard.

The interim orders allow the companies to continue using the label on the products covered by their cases. The Food Safety and Standards Authority of India had directed makers of high-caffeine beverages to abandon the description, arguing that it did not fit the category recognised by the regulatory framework. The companies say the direction disrupted distribution and put large quantities of finished stock and printed packaging at risk.

Reliance’s case also raised a procedural objection: its beverages business said the regulator acted without first giving it an adequate opportunity to answer the proposed restriction. The court questioned that sequence and issued notice to the regulator. PepsiCo and Monster received comparable temporary protection in proceedings heard the same day.

The ruling does not decide whether “energy drink” is a lawful description under Indian food rules. It preserves the existing position for the petitioners while the court considers the regulator’s authority, the applicable labelling standards and the process followed before the direction was issued.

A similar order obtained earlier by Red Bull forms part of the developing litigation, but each company’s petition remains procedurally distinct. The final outcome could determine whether the regulator may remove a familiar market description through an administrative direction or must proceed through a more formal rulemaking and notice process.
