Stripchat remains subject to the Digital Services Act’s stricter rules for very large platforms after the EU General Court dismissed its challenge on October 14.
The dispute turned on how users were counted. Operator Technius reported about 31.8 million monthly active recipients in the EU. The European Commission calculated more than 62 million, above the law’s 45 million threshold.
According to the court’s account of the judgment, Technius deducted visits that the underlying analytics measure had already filtered. The court accepted the Commission’s methodology and found that its decision was adequately explained.
Later revisions to the analytics provider’s methodology produced a lower estimate. They did not invalidate the designation, the court said, because legality had to be assessed against the facts and law at the time of the Commission’s decision.
The ruling rejects the annulment action, rather than imposing a fine for a separate breach of platform duties. An appeal limited to points of law may be brought within two months and ten days of notification.
