Former FBI Officials Face Charges Over Testimony on Hunter Biden Investigations

Two former senior FBI officials are facing federal charges over allegations that they misled a congressional committee about their knowledge of investigations involving Hunter Biden, the son of former US President Joe Biden.

Nikki Floris, 46, and Bradley Benavides, 56, were charged in federal court in Washington. According to a criminal complaint, both allegedly gave misleading testimony to the House Judiciary Committee in 2023 regarding the FBI’s handling of the Hunter Biden investigations and a laptop reportedly linked to him.

The case brings renewed attention to one of the most politically divisive controversies surrounding the 2020 US presidential election.

Former Agents Accused of Concealing Their Involvement

Floris and Benavides previously held senior counterintelligence positions at the FBI and worked with its foreign influence task force, which was established to counter efforts to interfere in US elections.

The complaint alleges that their congressional testimony understated their knowledge of the Hunter Biden investigation. Investigators claim the two officials had contact with members of the investigative team in 2020 and were involved in the FBI’s response when reports about the laptop emerged shortly before the election.

According to the complaint, Benavides told lawmakers that he learned about the investigations by searching Wikipedia.

The two officials had also briefed Republican senators in 2020 about intelligence concerns that certain allegations involving Hunter Biden could have been connected to a Russian influence operation, according to earlier media reports.

Floris’ legal team rejected the charges, describing the case as politically motivated and accusing the government of pursuing a narrative designed to score political points.

Benavides’ lawyer also condemned the prosecution, calling the charges a disgrace and describing his client as a patriot who had devoted his career to protecting the country.

US Attorney Jeanine Pirro defended the action, arguing that federal officials should be held accountable if they deliberately mislead Congress, regardless of their position or past service.

Floris and Benavides appeared in court for an initial hearing. A federal grand jury must approve an indictment for the case to proceed.

Laptop Controversy Returns to the Spotlight

The allegations revolve around the FBI’s handling of a laptop reportedly belonging to Hunter Biden, which became a major political flashpoint in the weeks before the 2020 election. Donald Trump and his allies have repeatedly argued that the laptop story was suppressed to shield Joe Biden’s presidential campaign.

The current complaint, however, focuses on the former officials’ testimony to Congress. It does not itself establish that the FBI or social media companies deliberately suppressed the story to protect Biden.

Hunter Biden subsequently faced federal charges involving firearms and taxes during his father’s presidency. Joe Biden later pardoned his son shortly before leaving office in January 2025.

The controversy has remained a central issue for Trump and his political allies, who have repeatedly challenged the conduct of federal law enforcement and intelligence agencies during investigations involving the former president and his opponents.

Wider Scrutiny of Federal Agencies

The prosecution comes amid a broader series of Justice Department investigations involving officials and decisions that have drawn criticism from Trump and his supporters.

The department has examined intelligence assessments concerning Russian interference in the 2016 election, as well as the FBI’s 2022 search of Trump’s Mar-a-Lago property as part of an investigation into classified documents.

Another high-profile case involved former FBI Director James Comey, who faced charges related to alleged false statements to Congress and a separate social media post interpreted by authorities as threatening. The congressional testimony case against Comey was later dismissed.

For Floris and Benavides, the immediate question is whether prosecutors can establish that their testimony was deliberately false. The case is also likely to intensify the political battle over the FBI’s conduct during investigations connected to the Biden family and the 2020 election.
