Jurisdiction and scope: Federal/onshore United Arab Emirates intellectual-property intake and registration triage. This note does not state DIFC or ADGM court procedure, customs recordal procedure or a complete infringement-remedies analysis.
Law checked: 18 October 2026. Next review: 18 January 2027.
Short answer
Identify the right before choosing a filing route. Trade marks, copyright, patents and industrial designs are governed by different federal instruments and require different evidence. For industrial designs, do not use the former 10+5+5 term: the current statute provides 20 years from filing, subject to annual fees.
When this note applies
Use this workflow when advising on protection through the UAE Ministry of Economy and Tourism under the federal regime. Start with the Ministry’s official intellectual-property legislation index, which identifies the operative federal statutes and implementing material. If the issue is infringement, border detention, domain names, a free-zone rule or criminal enforcement, open a separate procedure file.
Registration and protection workflow
- Classify the asset. A brand sign may require trade-mark protection; a technical invention may require patent analysis; a product’s visual appearance may be an industrial design; and original expression may fall under copyright. One product can engage more than one right, but the legal tests and filing evidence are not interchangeable.
- Identify the owner before filing. Obtain creation and commissioning agreements, employment provisions, assignments, corporate records and inventor or author details. Resolve title before submitting an application; do not assume the payer, manufacturer or distributor automatically owns every right.
- Preserve priority and confidentiality. Record the earliest disclosure, sale, exhibition and foreign filing dates. For an invention or design, control disclosure while patent counsel checks novelty, priority and available filing routes. Do not publish a design or technical disclosure merely to create evidence without checking the statutory consequences.
- Search the relevant register and market. A company-name or domain search is not a substitute for a trade-mark search. For patents and designs, search the technical or design field and assess the statutory requirements. Keep the search strategy and results in the file.
- Prepare the correct application. Use the Ministry’s current service portal and requirements for the particular right. Confirm the applicant, representative authority, classification, representations or specification, priority documents, translations and payment instructions. Do not rely on a form copied from an older article.
- Track examination and publication. Diary each official communication, response period, publication, opposition window and grant or registration step shown in the Ministry file. The controlling deadline is the one attached to the actual application and operative rule, not a generic internet timetable.
- Maintain the right. Create a docket for renewal or annual fees, address and ownership changes, licences, assignments and recordals. For an industrial design, Article 45 fixes a 20-year term beginning on the filing date and requires annual fees throughout the protection term.
- Prepare enforcement evidence separately. Preserve the registration or application record, chain of title, samples of the protected work or product, dated evidence of the alleged infringement, purchase records, web captures and loss evidence. Select the forum and remedy only after identifying the defendant, conduct, location and right relied upon.
Documents and decisions checklist
- Asset description and photographs, drawings, source files or technical material;
- Applicant’s corporate or identity documents and representative authority;
- Employment, commissioning and assignment instruments establishing title;
- Inventor, designer or author information;
- Foreign applications and priority documents;

Common errors
- Using a trade licence or company-name approval as proof of trade-mark protection;
- Filing in the name of an entity that has not received a valid assignment;
- Publishing an invention or design before checking novelty and priority consequences;
- Applying one right’s term or procedure to another;
- Repeating the obsolete 10+5+5 industrial-design term; and
- Quoting fees without checking the current Ministry service card and applicable decision.
