In a pivotal turn of events, a Missouri judge has significantly reduced a staggering $1.56 billion verdict against Bayer to $611 million. The verdict pertains to a lawsuit involving three individuals who alleged that exposure to Bayer’s Roundup weed killer led to their development of cancer. The reduction in punitive damages marks a crucial point in the ongoing legal battle surrounding the controversial herbicide.
Bayer, a German multinational corporation, acquired Monsanto, the manufacturer of Roundup, in a monumental deal in 2018. However, since then, the conglomerate has found itself embroiled in a multitude of legal disputes regarding the safety of Roundup and its active ingredient glyphosate.
The initial verdict, handed down by a Cole County, Missouri, jury in November, found Monsanto liable for negligence, design defects, and failure to adequately warn consumers about the potential risks associated with Roundup. The jury awarded a staggering $1.5 billion in punitive damages, in addition to $61.1 million in compensatory damages, divided equally among the plaintiffs.
However, in a recent ruling, Judge Daniel Green made a significant reduction to the punitive damages, bringing the total down to $611 million. This decision aligns with the U.S. Supreme Court’s guidance, which suggests that punitive damages should generally not exceed nine times the compensatory damages.
While Bayer has expressed intentions to appeal the decision, it faces an uphill battle in its efforts to overturn the verdict. The company maintains that decades of scientific research support the safety of Roundup and glyphosate. Nevertheless, the plaintiffs’ legal representation argues that the reduced damages accurately reflect Monsanto’s disregard for consumer safety.
The case represents just one facet of the extensive litigation surrounding Roundup. Bayer previously agreed to a $10.9 billion settlement in 2020 to resolve a significant portion of the claims against it. However, a substantial number of cases remain unresolved, indicating that the legal saga is far from over.
Despite recent setbacks, Bayer continues to defend its product vigorously. Yet, with each verdict that favors the plaintiffs, the conglomerate faces increasing pressure to address the safety concerns surrounding Roundup.
