Special Case Proceedings – A Look at the Civil Procedure Code (CPC)

Editorial correction — 14 October 2026. The former note treated “special case proceedings” as though it were a defined CPC category and said appeals from interlocutory applications were subject to the court’s discretion. The Code creates distinct mechanisms with different gateways. Appealability is statutory, principally under section 104 and Order XLIII; it is not conferred ad hoc by the trial court. This replacement is a classification and filing guide.

Jurisdiction and scope: India; ordinary civil courts applying the central Code of Civil Procedure, 1908. State amendments, High Court original-side rules, the Commercial Courts Act and special statutes may alter the route. Law checked: 14 October 2026.

Short answer

Do not file a generic “special proceeding” application. First identify the procedural source: a summary suit under Order XXXVII; execution under section 47 and Order XXI; interim relief under section 94 and Order XXXIX; an appealable order under section 104 and Order XLIII; or a revision under section 115. Each has a different pleading, notice, evidence and review route. If a special statute creates the cause of action or forum, that statute—not a loose CPC label—controls.

Classification steps

  1. Identify the source of jurisdiction. State the substantive cause of action, court, pecuniary and territorial basis, and the exact CPC section or Order invoked. If a tribunal or special Act supplies an exclusive remedy, confirm whether the CPC applies directly, by incorporation or only as a procedural guide.
  2. For a summary suit, prove Order XXXVII applicability. Order XXXVII is not available merely because the claim appears strong. Confirm that the court and claim fall within rule 1 and plead expressly that the suit is under the Order and that no relief outside its scope is claimed. Use the prescribed summons procedure. The defendant’s appearance and later application for leave to defend are governed by the ten-day periods in rule 3; do not treat an ordinary written statement as the first response.
  3. For execution, use section 47 and Order XXI. An execution petition enforces a decree; it is not a second merits suit. Identify the executable decree, judgment-debtor, outstanding amount or act, selected mode of execution and assets or person targeted. Questions between the parties or their representatives relating to execution, discharge or satisfaction are determined by the executing court under section 47, subject to the Code.
  4. For temporary relief, match Order XXXIX. Specify whether relief is sought under rule 1 or rule 2 and prove the relevant facts. If an order is proposed without notice, rule 3 requires the court to record why delay would defeat the object and requires the applicant immediately to deliver or send the prescribed papers. Rule 3A directs the court to endeavour to dispose of the injunction application within 30 days; it is not an automatic expiry date for the order.
  5. Classify the order before advising an appeal. Section 104 and Order XLIII rule 1 list appealable orders. A trial court does not make a non-appealable order appealable by describing the issue as important. If no immediate appeal lies, section 105 may permit an error affecting the decision of the case to be raised in an appeal from the decree, subject to its terms and the special rule for remand orders.
  6. Use revision only within section 115. Identify the case decided, the subordinate court, the jurisdictional error alleged and the proviso. Revision is not a substitute for an appeal or a general rehearing of fact and law. Also check the controlling High Court’s amendments and precedents.
  7. Separate pleadings from applications. A plaint and written statement are governed principally by Orders VI–VIII. An execution petition, injunction application, summary-suit appearance or revision petition has its own source and required contents. Do not assume that an affidavit alone supplies jurisdiction or cures a missing statutory element.
  8. Calendar the correct clock. The CPC provision may set a procedural period, but appeal, revision and application limitation often comes from the Limitation Act or a special statute. Record the impugned act, date of knowledge where legally relevant, excluded time, court closure and any condonation power before stating a deadline.

Decision and document checklist

  • Cause of action and substantive statute
  • Court, pecuniary, territorial and subject-matter jurisdiction
  • Exact CPC section, Order and rule
  • State amendment, High Court rule and commercial-court status
  • Pleading or application required; affidavit and exhibits
  • Service form, response period and proof of service
  • Whether the order is immediately appealable under Order XLIII
  • Alternative later challenge under section 105
  • Revision gateway under section 115, if invoked
  • Limitation source and computation sheet

Common errors

  • Using “special case proceeding” as a source of jurisdiction.
  • Filing every debt claim as a summary suit without satisfying Order XXXVII.
  • Calling every interlocutory order appealable at the court’s discretion.
  • Treating execution as a retrial of the decree.
  • Converting section 115 revision into a second appeal.
  • Quoting a nationwide deadline without checking the Limitation Act, state amendments and local rules.
