Supreme Court Vigilance: Curbing Misuse of Criminal Justice for Vested Interests

In a recent pronouncement, the Supreme Court raised a cautionary flag against the nefarious manipulation of the criminal justice system by certain individuals to serve their own hidden agendas. The court emphasized the crucial role of vigilance by judicial bodies in thwarting such malevolent endeavors.

Expressing deep-seated concerns, a bench comprising Justices BV Nagarathna and Augustine George Masih underscored the necessity for courts to remain vigilant in the face of such misuse, ensuring that acts detrimental to societal integrity are promptly identified and addressed.

The crux of the matter revolves around allegations leveled against Vishal Noble Singh, the Principal of Bishop Johnson School and College, a minority educational institution under the auspices of the Diocese Education Board, Lucknow, governed by the Church of North India.

The complaint alleges that Singh and cohorts engaged in criminal activities, including the fabrication of documents, operating the school under false pretenses since 2014, and siphoning off funds amounting to Rs. 13 crores collected from female students.

Charges under various sections of the Indian Penal Code were pressed against the accused, leading to the filing of a petition seeking the quashing of the FIR before the High Court, albeit unsuccessfully.

Upon review, the Supreme Court expressed doubt regarding the applicability of the charges outlined in the FIR to the accused. It cited the absence of conclusive evidence supporting the alleged offenses, thereby challenging the basis for criminal prosecution.

Drawing from precedent, the court emphasized the need for judicious exercise of judicial powers, cautioning against the misuse of legal proceedings for personal vendettas or harassment.

Furthermore, the court criticized the complainant’s failure to substantiate the allegations, questioning the integrity of accusations made without sufficient evidence.

In a decisive move, the Supreme Court overturned the High Court’s ruling and quashed all proceedings against the appellant-accused, highlighting the imperative to uphold justice while safeguarding against the misuse of legal machinery for ulterior motives.

In its resolute stance, the court reaffirmed its commitment to preserving the sanctity of the criminal justice system, ensuring that justice is served impartially and without prejudice.
