Late Diesel Claimants Get Final 21-Day Reprieve

The High Court refused an immediate strike-out but imposed a final deadline on claimants left outside the emissions group register.

The High Court has given a group of late diesel-emissions claimants 21 days to put their cases into compliant form, refusing an immediate strike-out while making clear that the indulgence is final.

The claimants had missed the deadline for entry on the Pan-NOx group register. That left them outside the group litigation order, but it did not automatically extinguish their underlying claims. The defendants sought to have the proceedings struck out because the pleadings had not been regularised.

In a procedural ruling delivered on 28 October, the court declined to end the claims at once. It ordered the claimants to serve compliant generic particulars within 21 days. Claims supported by those particulars will then be stayed; any claim that does not comply will be struck out automatically, without a further hearing.

The ruling does not decide whether any vehicle breached emissions law or whether any claimant is entitled to damages. It is confined to case management and the consequences of missing the group-register cut-off, preserving the claims only on strict conditions.
