US Challenges St. Paul and Portland Restrictions on Masked Officers

Two new lawsuits put municipal accountability measures against federal claims of constitutional immunity.

The Justice Department has sued St. Paul and Portland over municipal rules limiting face coverings and requiring identification by federal law-enforcement officers.

The two complaints, filed on October 15 in Minnesota and Oregon, seek declarations that the challenged provisions violate the Constitution’s Supremacy Clause and injunctions preventing their enforcement against federal officers. Neither filing is a ruling invalidating the ordinances.

The federal government argues that the cities cannot directly regulate how its officers perform their duties. It says identification and masking restrictions expose officers to harassment, interfere with sensitive operations and threaten enforcement through local penalties.

St. Paul’s council presented its ordinance differently when adopting it in February: as a safeguard for residents encountering unidentified officers and a means of promoting transparency and accountability. The city’s published explanation said the measure responded to residents’ concerns about federal operations carried out with officers’ faces obscured.

The legal dispute therefore concerns who may impose those requirements, not merely whether visible identification is desirable.

The St. Paul complaint challenges separate identification and face-covering ordinances. It points to provisions allowing misdemeanor punishment for knowing and wilful violations. The Portland complaint challenges identification standards, a masking restriction and the city’s enforcement arrangements.

The federal claims rely on intergovernmental-immunity principles. The governments’ competing interests will have to be considered within the applicable constitutional tests; the Justice Department’s description of the laws as unlawful is its litigation position.

The requested relief is directed at application of the local provisions to federal officers. The cases remain at the complaint stage in the documents reviewed.
