US Contractor Charged Over Alleged Classified-Information Leak

A US government contractor was arrested and charged under the Espionage Act with transmitting national-defence information to an online publisher.

A US government contractor with top-secret clearance has been arrested and charged by criminal complaint with unlawfully transmitting national-defence information to a person who published classified material online.

Ian A. Brinksman, 42, was arrested on October 23 after the FBI searched his Washington residence. The Justice Department says he worked first for a government agency in Virginia and later as a systems-integration developer for a contractor serving the same agency. He held Top Secret clearance with Sensitive Compartmented Information access.

The complaint alleges that Brinksman obtained classified material outside his assigned responsibilities and passed it to a person with whom he had a romantic relationship. Prosecutors describe that person as the operator of an online publication who had publicly solicited leaks and claimed to report from classified agency assessments.

The government has charged unlawful transmission of national-defence information, an offence prosecuted under the Espionage Act. That label does not establish espionage on behalf of a foreign power, and the department’s announcement did not allege that Brinksman was paid for the information.

The case is at the complaint stage. The affidavit sets out the government’s probable-cause theory, not findings of guilt, and Brinksman is presumed innocent. Prosecutors must still pursue the charge through the applicable federal criminal process, where the classification status, Brinksman’s access and the alleged transmission will be contested or proved.
