UnitedHealth Hit with $1 Million Fine for Birth Control Coverage Violations in New York

In a significant regulatory action, UnitedHealth Group Inc. has been fined $1 million by the state of New York for failing to comply with mandates on birth control coverage. The penalty was announced by New York Attorney General Letitia James, who emphasized the importance of reproductive health care rights.

The fine settles an investigation into UnitedHealthcare of New York, sparked by a Brooklyn patient’s complaint. The patient reported being denied coverage for her prescribed oral contraceptive and was required to seek prior authorization or alternative treatments, violating New York’s Comprehensive Contraceptive Coverage Act of 2020. This state law mandates that insurers cover all FDA-approved contraceptives without copays, restrictions, or delays, going beyond the requirements of the federal Affordable Care Act.

Attorney General James highlighted the necessity for health insurers to adhere strictly to these laws, ensuring the safety and wellbeing of New Yorkers. As part of the settlement, UnitedHealthcare has committed to refunding those who were wrongly denied coverage, with an additional 12% interest on reimbursements.

UnitedHealthcare has issued an apology for the delays in access to certain contraceptives and is actively working to resolve these claims. This settlement is part of a broader initiative by James’ office to uphold reproductive rights. In previous actions, James has targeted anti-abortion groups and crisis pregnancy centers for violating reproductive health laws.
