Who’s Watching?
The question of who can challenge such gifts remains foggy. While members of Congress or states might try to sue if they see a constitutional breach, courts require plaintiffs to prove they have the right “standing” — a legal hurdle that has stopped many cases before.

There may be a loophole. A 1990 law permits the Secretary of Defense to accept foreign contributions for defense programs, possibly covering the plane if transferred to the Air Force, which operates presidential aircraft.
