Australian Court Approves Final Distribution Plan for Immigration Investment Fund

BRISBANE — The Federal Court of Australia authorized liquidators of Royal National Capital Alliance to distribute the remaining property of an investment trust and to recover specified costs and remuneration from trust assets, bringing a long-running corporate insolvency closer to completion.

Royal National acted solely as trustee of the Royal JC Fund, which collected money from investors seeking to qualify for an Australian investment-visa category. The fund placed tens of millions of dollars into mortgage-backed property developments in Southport, Hope Island and Surfers Paradise.

Directions for the liquidators

Justice Sarah Derrington held that liquidators Daniel Walley and Derrick Vickers were justified in declining to conduct public examinations, discontinuing recovery proceedings connected to the Hope Island development and distributing the remaining assets after costs and creditor claims.

Members will receive distributions limited to the realized asset in which each invested, shared proportionately among investors in the same asset. The court also approved payment of legal expenses and A$135,322.50 plus tax in liquidators’ remuneration from the Southport proceeds.

The liquidators may draw general costs from trust property when the work relates to administering the trust as a whole rather than to a specific mortgage investment.

Why court directions matter

A company acting as trustee can hold property for beneficiaries in a capacity distinct from its own assets. When that company becomes insolvent, liquidators often seek judicial directions before spending trust funds or deciding that further litigation would cost more than it is likely to recover.

The court’s approval protects the liquidators when they act in accordance with the directions and gives investors a defined method of distribution. It does not restore losses from developments that produced no available return.
