Division Bench Upholds Militant’s Life Imprisonment

The Jammu & Kashmir and Ladakh High Court’s Division Bench upheld militant Mushtaq Ahmad Malla’s life sentence from Additional Sessions Judge Handwara. The Handwara Police Station received information on 22.12.2005 that two militants had shot and killed Tariq Ahmad Malik, the son of Abdul Qayoom Malik from Guloora, indiscriminately at Adoura. Sections 302 of the Ranbir Penal Code (RPC) and 7/27 of the Arms Act were alleged in FIR No. 337/2005. On December 31, 2021, the accused was challaned and sentenced to life. After hearing arguments from both parties, the Division Bench noted that the trial court had considered and addressed all of the accused-concerns appellant’s in accordance with Apex Court judgements.

The District Court sentenced the appellant to life for violating RPC Section 302. The trial court also convicted the appellant under Section 201 of the RPC because there was direct evidence of the appellant killing the deceased and fleeing with a gun. The trial court’s conviction and sentence were legal, according to the DB.
