The High Court of Jammu and Kashmir has issued an order regarding the designation of additional commercial courts and a family court in the region. The order aims to ensure the smooth functioning of these courts and streamline the distribution of work. The decision comes in response to the government’s notification, designating specific courts for commercial and family cases.
According to Order No. 58 of 2023/RG, dated May 9, 2023, the Principal District and Sessions Judge in Jammu has been directed to transfer 1000 cases from the Court of Additional District Judge (Bank Cases/Commercial Court), Jammu, to his own court. Furthermore, the Principal District and Sessions Judge in Jammu will be responsible for equally distributing relevant cases to both courts in the future.
Similarly, the Additional District Judge (Bank Cases/Commercial Court) in Srinagar has been instructed to transfer 500 relevant cases from his court to the Court of Additional District and Sessions Judge, Srinagar, which has been designated as a commercial court. The Principal District and Sessions Judge in Srinagar will oversee the equal distribution of newly instituted cases to both courts going forward.
In addition, the Principal Judge of the Family Court in Srinagar has been directed to transfer 500 relevant cases to the Court of the 4th Additional District and Sessions Judge, Srinagar, which has been newly designated as an additional judge in the family court. The Principal Judge of the Family Court will distribute newly instituted cases in a 3:1 ratio between the two courts, under the supervision of the Principal District and Sessions Judge in Srinagar.
The order, issued by Registrar General Shahzad Azeem, aims to ensure a fair and efficient distribution of cases among the designated courts. It also emphasizes the need for coordination between the judiciary and administrative authorities for the smooth functioning of the justice system.
Copies of the order have been forwarded to various stakeholders, including the Principal Secretary to the Chief Justice of the High Court, Secretaries to the Honorable Administrative Judges in Srinagar and Jammu, and relevant court officials. The order will also be uploaded to the High Court’s website for public access.
The designation of additional commercial courts and a family court reflects the court’s commitment to expedite proceedings and provide timely justice in Jammu and Kashmir. By streamlining the distribution of cases, the High Court aims to enhance efficiency and ensure the proper administration of justice throughout the region.
