In a pivotal ruling, a U.S. appeals court has reignited a legal battle against Oklahoma’s law barring transgender individuals from amending their birth certificates to reflect their gender identity. The decision, handed down by a panel from the 10th U.S. Circuit Court of Appeals, overturned a previous dismissal, asserting that the law unjustly discriminates against transgender people without a valid justification.
“This marks a significant victory for Oklahoma’s transgender community and sets a crucial precedent nationwide,” declared Peter Renn of Lambda Legal, representing the plaintiffs.
The dispute dates back to 2021 when Governor Kevin Stitt of Oklahoma issued an executive order prohibiting changes to birth certificates after an amended certificate was issued to a non-binary individual. The subsequent legislative reinforcement of this ban in 2022 prompted legal action from three transgender plaintiffs who argued it violated their rights and perpetuated discrimination based on gender identity and sex.
Initially dismissed by a lower court, the case was resurrected on Tuesday by 10th Circuit Judge Carolyn McHugh. She highlighted the inconsistency of the law with federal protections against sex discrimination, as established by the U.S. Supreme Court in a landmark 2020 decision extending such protections to gender identity and sexual orientation.
“This policy lacks a rational basis and fails to align with legitimate state interests,” Judge McHugh emphasized, suggesting the state must substantiate its position more robustly to justify the ban.
While Oklahoma’s Attorney General expressed disappointment and indicated a review of options, advocates for transgender rights hailed the appellate court’s decision as a clear message against unconstitutional discrimination.
